GDPR - One Week To Go!

Unless you've been living in a cave for the last few months you'll be aware of the new General Data Protection Regulation (GDPR) which is coming our way fast.

It takes effect on May 25th and your inbox will almost certainly reflect that as companies clamour for your consent to continue contacting you via their email subscription lists.

Once GDPR kicks in pre-ticked boxes can no longer be used to indicate consent to a company’s terms and conditions. Plus, a request for consent cannot be buried under pages and pages of terms. You can request a copy of any personal information held, and you can ask a company to delete all the data they have on you.

So if you use Mailchimp, Constant Contact or any other mass mailing platform to keep in touch with your customers you should read up (quickly!) on what you need to do to re-enable consent from your customers. Mailchimp has a series of articles on the subject that explain in depth what you need to do, and what tools they are giving you to do it, via articles such as this one and this excellent and thorough PDF on the whole subject.

Meanwhile from a website point of view there are a couple of things you need to do.

Firstly you need to revise, review, or even create a Privacy Policy. We use Google Analytic tracking on all the sites we design, and you need to specifically state that to your visitors so that they are aware. This data is anonymous but even from a cookie tracking perspective you need to clearly state that the visit to your website is being recorded.

Secondly if you have a contact form on the website and you aim to use data from that form for email marketing purposes, either now or in the future, you should ensure there is a checkbox (which isn't ticked by default) that asks for your customers explicit consent to be contacted.

On the Privacy Policy itself if you are struggling you can follow our own Privacy Policy as a starter for ten and customise as you wish with your own company details and anything else specific to your organisation. Once you've created your policy just send it over to our support team and we will be happy to add it to your website.
